  1. Introductory provisions

    These Terms and Conditions are an integral part of the Rental Agreement (hereinafter referred to as the „contract“) concluded between Holiday Estates s.r.o., with its registered office at V háji 1092/15, Prague 7, IČ: 27450651, DIČ: CZ27450651, (hereinafter referred to as the „company“) on the one hand and a natural or legal person interested in the short-term lease of an apartment specified in the contract (hereinafter referred to as the „client“) on the other. By visiting and viewing our website https://holidayestates.com/, using it and / or requesting / making a booking, the client confirms that he has read and understood the terms and conditions below and agrees with them. The company hereby declares that it is entitled, by agreement with the owner of the flat, to leave the flat (hereinafter referred to as the „apartment“) in question for use by a third party.

    The client declares that through the website of the company operated at www.holidayestates.com (hereinafter referred to as the “web”) or in any other way (for instance by phone or e-mail), he sent a binding inquiry / booked the sublease of the chosen apartment for chosen period for the price shown at the web / given by the e-mail and for the number of persons notified by him, thereby confirming the agreement with these terms and conditions, thereby establishing a contract between the company and the client.

    By concluding the contract and after paying the rental price, the company leases and concedes to the client (and to the number of persons designated by him) for short-term use the apartment specified in a time and material extent by the contract, and the client accepts the apartment for sublease and undertakes to use it exclusively for the agreed purpose and for the number stated persons. The company is entitled to change the agreed booking conditions in cases beyond its control (such as the force majeure).

    If the client requests an invoice issued on a company name (the VAT number and the name of the company are needed), the client is obliged to send the request maximally till 7 days from the day of confirmation of payment of the reservation.

  2. House rules

    The client and other persons together using the apartment undertake: 
    a) not to smoke in the apartment, otherwise a penalty of EUR 50 will be charged
    b) not to disturb the peace at night from 10 p. m. to 8 a. m.,
    c) not to make any alterations and changes in the apartment, including manipulation with the equipment and electric devices,
    d) not to take any animals to the apartment (unless there is an exception in the advertising),
    e) to leave the apartment on the last day of the stay in the same conditions, in which they handed it over and in the agreed time,
    f) not to occupy the apartment by more persons than is the capacity of the apartment listed in the advertisement.

    The client also undertakes to read the guidebook of the apartment, including the manuals of separate appliances in the apartment. In case of a baseless visit from the side of the company at the client´s request, the client will be obliged to pay the company the contractual penalty in the amount EUR 20 and the company is authorized to withdraw this amount from the security deposit.

  3. Rental price and security deposit

    The rental price is the price that the client undertakes to pay to the company for the period of the lease. The rental price consists of the accommodation fee and the cleaning fee. The amount of the cleaning fee is stated in the apartment description and repeated in the inquiry form, when it becomes part of the total price to pay. The following services connected with the use of the apartment are included in the rental price: energy consumption, final cleaning, bed linen, towels. The apartment reservation is confirmed after paying the rental price.

    The client further undertakes to allow the company to pre-authorize a refundable security deposit (hereinafter referred to as the "deposit") on the credit or debit card no later than on the day of the handover of the apartment to the client (arrival day). The deposit serves for covering client’s obligations in connection with the apartment using, in particular the damages caused by the client in the apartment, the damage of the equipment or furnishing, loss or damage of the client keys/entrance card/chip/remote control or in the common areas of the house, in which the apartment is placed and in case of violation of any rule referred to in point 2. In the case of violation of any obligation stated above by the client the company is authorized to fine the client and the client is obliged to pay the company up to the contractual penalty. In this case, the client expressly agrees that this deposit will be used for these purposes. The payment of the contractual penalty shall not affect the company’s right to demand compensation from the client for any damage caused. In the case that the client will find any deficiencies or damages, and/or functionless equipment in the apartment, they are obliged to report this within 12 hours after check-in. If they do not make it, they are responsible for these deficiencies or damages, and/or for functionless equipment as if they caused it.

    The exact amount of the deposit is stated in the apartment description and repeated in the inquiry form. The deposit will be secured by credit card pre-authorization. Pre-authorization can be done on a Mastercard or Visa credit card (except Visa Electron). It cannot be done on Visa ELECTRON, Union Pay, Maestro or Amex cards. In the case that the deposit will not be drawn from the reasons stated in these Terms and Conditions, the deposit will be released to the client no later than seven working days from the rent termination. The company asks the client for patience, it may take several days for the bank to process the transaction.

    If the type of apartment allows the use of self-checkin and the company and the client agree on its use, then the client agrees to secure the deposit at distance and no later than in the morning on the day of the arrival. Clients cannot be accommodated without pre-authorization of the deposit.

  4. Additional services

    Please note that special requests are subject to availability and may incur additional charges.

    The current offer of services and their range varies according to the location where the apartment is situated. A specific list of services can be found in the Services section of the main menu on the web.

  5. Check-in – client´s registration and collecting the keys

    The client undertakes to inform the company in advance of his / her estimated time of arrival at least one day prior to arrival. Contact details can be found on the booking confirmation. Clients are required to show a photo identification and credit card upon check-in (to pre- authorize the deposit, if the pre-authorization of the deposit has not been pre-authorized at distance before the check-in). The company also offers the possibility of online checkin and self-checkin. The possibility of using these methods depends on the particular apartment and the agreement between the client and the company. Contact the company for more information.

    Check-in is possible from 14:00. Early check-in is subject to availability resulting from the departure of previous clients and the time required to clean and prepare the apartment. Contact the company for specific options. Arrival after 20:00 for apartments located in Moravia district and after 21:30 for apartments in Bohemia district is possible only after prior confirmation by the company and may be subject to a fee - depending on the apartment (shown in the apartment description) and the possibility of using online and self-checkin methods.     The handover of the keys of Prague apartments takes place at: Těšnov 15, Prague 1, 110 00, where there is a reception on the ground floor with opening hours from 9:30 to 21:30. Clients arriving before 14:00 can store their luggage free of charge in the luggage storage.

    Key collection for other locations and their apartments takes place at the address of the apartments.

  6. Check-out - departure of the client and handover of keys

    The check-out is maximally till 10:00 a.m. Late check-out is always a subject to availability and it comes with an additional fee. If the client wishes to check out later, this can be requested in advance using the contact details found on the booking confirmation or at check- in.

    When checking out the client undertakes to leave the keys on the table inside of the apartment (not in the door lock) and close the door properly. If the client leaves the keys in the lock (inside the apartment) and it is necessary to call a locksmith, the client will pay the costs associated with this extra service from the deposit.   

  7. Cancellation by customer

    Non-refundable. In case of cancellation at any time after booking confirmation, the client pays 100% of the total price of the reservation.

  8. Processing of personal data

    The client agrees to process his personal data: name and surname, address, nationality, passport and visa number (if needed), date of birth, email address, telephone number (hereinafter collectively referred to as the "personal data").

    The client agrees with the collecting and processing of his personal data by the company for the purpose of realizing the rights and obligations of the concluded contract as well as sending commercial communications. The client acknowledges that he is required to indicate his personal data correctly and truthfully. The company may assign a third person to process the client´s personal data, the third person is bound by an obligation of confidentiality. Personal data will be processed indefinitely. Personal data will be processed in electronic form in an automated way or in a printed form in a non-automated way. The client agrees with sending information and commercial communications related to the services of the Company to the client's email in accordance with Act No. 480/2004 Coll. on certain Information Society Services and on Amendments to some Acts.

  9. Other arrangements

    The contractual relation between the company and client and any non-contractual relations arising in connection with this protocol is governed by the laws of the Czech Republic; the Czech courts are relevant for the eventual disputes.
